Fire Damaged Buildings - Ordinance 14.01

The Town Board of the Town of Cloverland does hereby ordain as follows:

1. No owner of any building, having sustained fire damage that structurally weakens the building, shall re-establish and reoccupy the building before measures have been taken to assure structural concerns and deficiencies have been corrected. Prior to the issuance of any permit for the reconstruction or repair of any building that has sustained any fire damage, said building shall be inspected by the Joint Municipal Fire Commission or its designee. Said inspection shall occur prior to any remodeling, repair or reconstruction and also prior to the construction of any interior wall enclosure.

2. Whenever a building or structure, exclusive of the foundation, shows a 33% or more damage or deterioration of its supporting member or members or 50% damage or deterioration of its non-supporting members, enclosing or outside wall or coverings, it is within the jurisdiction of the Joint Municipal Fire commission to declare said building as dangerous and require repair, vacation or demolition. Repaired buildings shall comply with any building code of the State of Wisconsin or shall be demolished at the option of the building owner.

Any person in violation of any provision of this ordinance, upon conviction, shall forfeit not less than $25 nor more than $100 and compliance may be enforced by an injunction order of the Town or the owner or owners of land within the boundaries of the Town of Cloverland.
